What states are vapes illegal?
The FDA regulates the manufacture, distribution, and marketing of tobacco products. In September 2020 the agency began reviewing PMTAs, which stands for Premarket Tobacco Applications. They have rejected more than a million nicotine product applications and have only approved 23; all of which are menthol and tobacco flavored only. Local and state legislatures contribute to the majority of vape product bans however, whether or not the FDA will succeed in enforcing an unratified standard that targets legally flavored products can only be determined by federal courts in time. Most United States nicotine product regulations and bans involve flavors and online sales. Very few major restrictions have passed local legislatures despite vast overreaching proposals which shows that united opposition can put an end to poorly written laws.

- Arkansas – Ban on all online sales – Licenses issued to local stores only legally allow in-person transactions
- California – Ban on all flavors except tobacco in store – Online purchase of flavored products is legal but illegal in some localities
- Georgia – Ban on all online sales – similar to Arkansas’ legislation
Hawaii – Ban on all online sales out of state – Only licensed retailers can send and receive nicotine products
- Maine – Ban on all online sales – Only between licensed business owners can products be sent or received
- Massachusetts – Banned every flavor of all nicotine products except tobacco
- New Jersey – Ban on all Flavors except tobacco – After realizing the state would lose too much money from a ban on menthol cigarettes they kept them available to the public
- New York – Ban on all online sales of any nicotine products and all flavors except tobacco
- Oregon – Ban on all online sales except between business owners
- Rhode Island – Ban on all flavors except tobaccoÂ
- South Dakota – Ban of all online sales of any nicotine product
- Utah – Ban on all online sales except between business owners
- Vermont – Ban on all online sales except between business owners
What major cities with banned flavors?
Chicago, Illinois; Los Angeles, San Diego, Sacramento, Oakland and San Jose, California; and Boulder, Colorado. Flavor prohibitions are in place in hundreds of smaller counties and cities, primarily in California. Some larger cities had similar bans, but state bans have subsequently replaced them, for example New York City and Newwark.
